this earlier today. what's your take on the obama administration's signal here to the bankers? >> in a sense it's an amazing political pick in that the obama administration is banking on the idea that the elite media and politicians will see the word prosecutor in mary jo white's resume and say that means she must be tough on crime forget that she hasn't been a prosecutor for a decade and has been defending the biggest most powerful wall street c.e.o.'s in the country. politically, it's banking on voters, on the elite media simply not knowing who she really is. i think as a citizen as somebody concerned with the fact that the administration hasn't prosecuted a single wall street banker connected to the financial crisis, i think this is a terrible pick. i think wall street is celebrating right now saying the person who's in in the s.c.c. looks like she's going to get tough on us, but we know she has a record of defending our interest. >> >> cenk: the new york times explains she's not going to face much opposition from the republicans. >> shocking. >> cenk: michael david and i are clear on this.

we took aggressive action. our conference of mayors engage direct with the obama administration and congress through every step of fiscal cliff negotiations. at the national press club on september 15, we released a letter to vice president scott smith, our second vice president kevin johnson and i drafted, 131 of our mayors sign, calling on congress to adopt a bipartisan and balanced approach deficit reduction by incorporating spending cuts with additional revenue. we took the same message to both political conventions and to the presidential debate where mayors of both parties were active and visible participants, speaking for commonsense solutions to the pending fiscal crisis. in just one week after the election, our leadership came to washington. we met with the vice president biden in the white house, the entire house democratic leadership, senate majority caucus, and rising leaders such as senator marco rubio, and other key decision-makers, pushing for action to the fiscal cliff. during those meetings we made it known that cities have already led on deficit reduction. mayo

and the white house staff. the obama administration has appointed more czars than the romonovs. we've always had some czars, such as the drug czar, but they have three dozen, three dozen who aren't subject to the usual restrictions that we -- that we have through the appropriations process. and the most blatant example of the imperial presidency are the recess appointments at a time when the senate, according to this court, was not in recess in order to put on to those positions men and women with whom the senate would not agree. if the president could do what the president did on january 4, 2012, on a regular basis, we might take a recess break for lunch and come back and find we have a new supreme court justice. so, mr. president, i'm here to suggest that the right thing to do would be to respect the tradition of checks and balances that are built into our constitution. it's at work here, because the president took an action; we didn't like it. and the third branch of government has made a decision that the president was wrong. the way to go forward is for the two members of the national labor
